I. Programme Regulations
- The organiser of the “Discount Card” for teachers, hereinafter referred to as the “Club” or the “Programme” is Cinema City Poland a limited liability company, with its registered seat in Warsaw, ul. Fosa 37, 02-768 Warsaw, entered into the National Court Register (KRS) kept by the District Court for the Capital City of Warsaw under the KRS number: 0000707019, hereinafter referred to as the “Organiser”.
- These Regulations constitute the basis for the operation of the Club and define the rights and obligations of the Club Members, hereinafter referred to as “Club Members”.
- The content of these Regulations is available in every Cinema City cinema in Poland and on the following website: www.cinema-city.pl/klub-nauczyciela, hereinafter referred to as the Club Website.
II. General Provisions
- The Club is a programme designed for teachers visiting Cinema City cinemas (hereinafter referred to as “the Cinemas”).
- The participating Cinemas are located in Poland. A detailed list of the locations of Cinemas, along with available special formats is attached as Appendix no. 1 to these Regulations. Whenever these Regulations refer to a “Cinema”, this is understood to mean the cinema multiplex mentioned in the current version of Appendix no. 1 to these Regulations.
III. Obtaining Club Membership
- Every person who wants to join the Club is obliged to use the on-line (electronic) registration at www.cinema-city.pl/klub-nauczyciela. Upon completion of the application form, the Club Member will receive a Club Card (hereinafter also referred to as: Card), the specimen of which is attached as Appendix no. 2 to these Regulations, at the time and in the manner specified in the Regulations. The Card will be sent solely in electronic form (with the visible barcode or full Card number) to the email address provided in the aforementioned form.
- Registration is possible on-line at www.cinema-city.pl/klub-nauczyciela. Registration is initiated with the filling all fields in the form and clicking “join” button. Upon clicking this button, you will receive a confirmation of your application to the email address provided in the form and the Card with the visible barcode or with the full Card number will be sent to the future Club Member to the email address provided in the application form. Should the Card not be received within 14 days from the date of on-line application, the person who submitted the application is obliged to inform the Organiser of this fact. Upon receiving such information, the Organiser will contact the person concerned.
- The Club Member acquires membership rights upon receipt of the Card at the email address provided in the form, not upon registration. Receipt of the Card constitutes the moment of confirming acceptance into the Club. The card may be presented in the form of an email with the visible barcode or with the full Card number, or as part of a mobile application storing such cards, provided that it can be verified by an employee of the Cinema.
- In the event that the Card is lost, the Club Member is obliged to immediately inform the Organiser in order to receive its duplicate
- Club Member participates in the program in person and his or her membership and rights resulting therefrom are not transferable to another person. In particular, the Card cannot be lent or otherwise made available by the Club Member to another person for paid or free use.
- Each Club Member can only own one Card.
- The Club Member may at any time resign from participating in the Club according to the rules specified in these Regulations and at the same time demand that their data be erased and that the Organiser ceases its processing.
- If you hold the Card in a physical form received prior to 18 August 2020 (hereinafter referred to as: Physical Card), it shall not lose its validity and the rules of its use shall not change. The Physical Card should be legibly signed with the first and last name of the Club Member. An unsigned Physical Card is invalid. The provisions of the Regulations relating to the Card shall apply mutatis mutandis to the Physical Card.
IV. Club Membership Terms and Conditions
- Participation in the Club programme is open to natural persons who actively work as teachers and tutors in kindergartens, primary schools, secondary schools, special schools and colleges or universities, as well as to other educational professionals and tutors who actively perform duties in relevant educational institutions. By filling in the registration form, a person declares that he or she is a teacher or tutor actively practising his or her profession.
- Should the statement referred to in Clause 1 above prove to be untrue, the Organiser has the right to terminate a person's membership in the Club while at the same time invalidating his or her Card and demanding the return thereof.
- The Organiser reserves the right to verify whether the Club Member meets the conditions specified in these Regulations. For this purpose, they may require the Club Member or future Club Member to make appropriate representations, provide certain data or submit relevant documents for verification. The Organiser has, in particular, the right to request a document confirming the active practice of the teaching profession, at the time of registration or during membership in the Club. The Organiser also has the right to contact the educational institution indicated as the teacher's place of work in order to verify the data provided. Acceptance of these Regulations, and thus registration in the Club, is tantamount to the consent to the above.
- The Organiser or its representative may ask the person in possession of the Card to present documents confirming identity and meeting the criteria referred to in the Club Regulations in order to verify the correctness of the data provided during the application or use of the Card. In the event that a person holding the Card refuses to present such a document, the Organiser is entitled to refuse to execute the rights of the Club Member, in particular to refuse to sell tickets or other products with a
V. Authorisations of the Club Members
- Upon receipt of the Card, the Club Member is entitled to discounts indicated in the Regulations and to benefit from special offers addressed to Club Members. Special offers are understood here as information about promotions, competitions, bonus programs, conferences and other events that are addressed to Club Members, or those addressed to a wider group of Customers that, in the opinion of the Organiser, may be of interest to Club Members.
- In order to receive directly complete information on special offers for Club Members, it is it is necessary to consent to electronic communication (including receiving messages via e-mail communication to the e-mail address of special offers provided by yourself) and to provide data in the system used for electronic communication. Special offers will be sent to the email address of the Club Member. The Organiser will also publish information on special offers, if possible, on the following website: www.cinema-city.pl/klub-nauczyciela. The Organiser does not guarantee that all special offers will be available on the website. A Club Member may revoke consent to electronic communications to receive special offers electronically under the terms of article VI of these Regulations.
- The Club Member, upon presentation of the Club Card at the cinema box office, café and bar, is entitled to purchase once a day:
a. a maximum of two teachers' tickets dedicated only to Teacher's Club Members at the price of a group ticket each, in accordance with the specific price list in a given Cinema City cinema valid on the day of purchase;
b. or a maximum of two teachers' tickets dedicated only to Teacher's Club Members at the price of a group ticket each, in accordance with the specific price list in a givencinema for a screening in a special format: with IMAX, , 4DX, ScreenX technology and in rooms with COMFORT;
c. or a maximum of two teachers' tickets for rooms equipped with Relax and Sofa Duet seats, dedicated only to Teachers' Club Members, for the price of a group ticket plus the additional fee for a Relax or Sofa Duet premium seat, according to the current price list at the given cinema. A list of rooms with premium seats is available at the box office of the cinema where such seats are located.
d. a maximum of one Special Offer Duo , i.e. 2 x large drink and one large-sized: popcorn or nachos – to be selected in the appropriate cinema bars with a discount of 15% of the price of the Special Offer Duo, according to the offer and specified price list in a given;
e. a maximum of two coffees (possibility to choose from the following types: Espresso of 50 ml, Espresso Macchiato of 55 ml, Americano of 190 ml, Cappuccino of 200 ml, Caffe Latte of 200 ml, Flat White of 200 ml),in all bars or cinema cafes available in the Cinemas at a fixed and promotional price available exclusively to the Club Member, i.e., PLN 9.00 (in words: nine zlotys) for each coffee, regardless of the type of coffee and the current offer and specified by the price list in the respective Cinema.
3a. The Discount Card of the Teacher’s Club does not entitle to the purchase of discounted tickets for screenings in the VIP area, as well as for special screenings, especially Ladies Night screenings, movie marathons etc.
3b. The purchase of tickets with a discount for Club Members is possible only at the cinema box office upon presentation of the Card.
3c. The Club Member is entitled to the purchase of tickets with discount or other discounted products specified in Article V(3) only for himself or herself and one accompanying person who can take advantage of the promotion only when accompanied by the Club Member. The Discount Card of the Teacher's Club does not entitle the Club Member to purchase tickets with discount or other discounted products with the discount specified in Article V(3) of the Regulations for persons who are not Club Members and who are not accompanying a Club Member.
4. The purchase of tickets and other products referred to in Article V(3) cannot be combined with other promotions and offers applicable in a given Cinema City and IMAX cinema, unless the regulations of a given promotion or offer provide otherwise or the Organiser decides otherwise.
5. The Club Member can purchase tickets with a discount specified in Article V(3)(a),(b) or (c) of the Regulations for any movie, at any time indicated in the repertoire of the Cinema for the price specified in the current price list in the Cinema once per day, provided that there are tickets available for a given screening.
6. The Club Member may purchase products referred to in Article V(3)(d) or (e) of the Regulations for the price specified in the current price list of a cinema bar or café reduced in accordance with Article V(3)(d) (for products specified in Article V(3)(d)) or for the discounted price according to Article V(3)(e) (for the products specified in Article V(3)(e)). The Club Member, in case of lack of the product specified in Article V(3)(d) or (e), agrees to choose another product specified therein and undertakes not to raise any objections to the Organiser in this respect.
7. A necessary condition to benefit from the discount or discounted prices to which the Club Member is entitled under these regulations is the presentation of a valid Card (in a way that allows to scan the individual barcode or read the full Card number on the Card) and a document confirming the identity of the Card holder or confirming the accuracy of the data contained in the form – if requested to do so.
8. The Club Member has the right to cancel his or her membership in the Club at any time after prior notification (in writing or electronically) of his/her desire to cancel to the Organiser.
9. The cancellation should be sent electronically to the email address: [email protected] or in writing to the Organiser’s address: Ul. Fosa 37, 02-768 Warszawa. The card will be deactivated immediately upon receipt of a declaration of cancellation of the Teacher's Club membership. The Physical Card should be returned at the nearest Cinema City cinema or sent back to the Organiser's address within 14 days of sending the declaration of cancellation.
10. Based on §1 items. 1 and 2 of the Resultion of the Minister of Climate and Environment on the fee rates for single-use plastic products that are packaging, dated December 07, 2023 (Journal of Laws 2023, item 2679), in the case of the sale of food products in takeaway packaging, the following fees are added to the product price as of January 1, 2024:
a) PLN 0.20 + VAT for disposable plastic cups,
b) PLN 0.25 + VAT for food containers.
VI. The Card
- The Club membership commences upon receipt of the Card by the Club Member
- The Card is issued for an indefinite period.
- In case of the loss or misplacement of the Card or Physical Card, the Club Member is obliged to immediately inform the Organiser thereof. In such a case, the Organiser will deactivate the Card and issue another Card to the Member if the Member did not violate the Regulations during the Membership. Pending receipt of the next Card, the Member cannot exercise the rights granted to him as a Club Member. The new Card will be issued in electronic form. In case when it is not possible to use the Card in electronic form, the Club Member will have the possibility to resign from membership in the Club due to the lack of possibility to use the Card.
- In case the Club Member does not notify the Organiser of the fact of losing the Card, the Organiser is not responsible for any unauthorized use of the Card or any activity in breach of these Regulations. When a third party other than the Club Member uses the Card at the Cinema, the Organiser has the right to refuse the sale of tickets. The Organiser will also temporarily block the Card and attempt to contact the Club Member for explanations. In the absence of explanations provided within the specified period (not less than 14 days) or in the case of a justified suspicion that the Card was handed over by the Club Member to a third party – the Organiser will have the right to remove the Member from the Club.
- In case of removing a Club Member from the Club due to violation of these Regulations, the Club Member's Card will be deactivated and in case of possession of a Physical Card, the Club Member will be obliged to return it immediately. The Organiser has the right to refuse to re-admit a former Club Member to the Club and to refuse to allow him or her to take part in other promotions, programmes and clubs of the Organiser.
- The Discount Card for the discounted purchase of products listed in Article V(3)(a), (b), (c), (d) and entitling to the purchase of products specified in Article V(3)(d) in discounted price may also be shown in any mobile application for storing cards, provided that it is possible to scan the barcode or read the full number of the Card. The selection of the application and its operation are up to the Club Member and any activities related thereto are undertaken by him at his own risk and responsibility. The Organizer does not guarantee the availability of this solution on all available operating systems and applications.
VII. Membership data, data protection and privacy of Club members
- All membership data and information provided by the Club Member will be treated by the Organiser in accordance with the applicable laws, in particular in a manner consistent with the GDPR and in accordance with the rules contained in these Regulations. By filling in and submitting the application form, the Club Member agrees to participate in the Club and accepts all provisions of these Regulations.
- The Administrator of the personal data contained in the Club Members' personal database within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation; hereinafter: GDPR) is Cinema City Poland Spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw at ul. Fosa 37. The data may be disclosed to authorized employees or associates of the Organizer as well as to other entities providing support to the Company on the basis of commissioned services and in accordance with concluded agreements of entrustment. In particular, the data are processed by the Company Digitree Group Spółka akcyjna, based in Rybnik, 35A Raciborska Street, 44-200 Rybnik, KRS number 0000369700 (hereinafter referred to as "PS"). PS is an entity as defined in Article 28 of the GDPR
- The Data Administrator has appointed a Personal Data Protection Officer, who can be contacted at e-mail: [email protected] or by correspondence: the Data Protection Officer, Fosa 37 Street, 02-768 Warsaw.
- By filling in and submitting the application form, the Club Member acknowledges that his or her personal data will be processed by the Organiser as a data controller and by entities cooperating in the organisation of the Club as entities entitled to access data on behalf of and for the Organiser in order to enable and properly execute the rights and obligations related to the Club membership,in order to be able to join the Club,including settlements, handling possible complaints, contact related to the Club (pursuant to Article 6(1)(b) i.e. necessity for the performance of the concluded contract of the GDPR or, in addition, point (a) when expressing a desire to receive dedicated offers by electronic means), as well as for the purpose of carrying out marketing activities concerning own products or services (in a traditional form) pursuant to Article 6(1)(f) of the GDPR. Pursuant to Article 6(1)(f) of the GDPR, i.e. within the scope of the Organiser's legitimate interest, the Organiser will also archive data following the termination of the Club membership, for the purposes of defending, asserting or establishing claims – until the expiry of the statute of limitation in accordance with the Civil Code. Providing personal data is voluntary, as is membership in the Club, however, failure to provide such data prevents the exercise of the Club Member's rights. Personal data will not be subject to profiling, and no automated decisions will be made against data subjects. Personal data will not be transferred outside the European Economic Area.
- If the appropriate box is ticked in the application form, the Club Member agrees to:
a) receive information about offers dedicated to Card holders by electronic means (email), including the use of telecommunications terminal equipment; and/or
b) receive information about other offers, promotions and events organised by Cinema City by electronic means (email), including the use of telecommunications terminal equipment. - Regardless of the scope of data entrustment, we ensure that the personal data of the Club Member are protected in accordance with the GDPR and processed in accordance with the Act of 18 July 2002 on the provision of electronic services (Dz. U. [Polish Journal of Laws] No. 144, item 1204).
- Each Member of the Club has the possibility to access and update their personal data and the right to have their data erased in the case of resigning from the Club membership or cancelling the receipt of electronic offers. For technical reasons, these actions take place through the Organiser. Moreover, every data subject has the right to demand from the controller access to personal data, their rectification, erasure or restriction of processing, the right to object to the processing, the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office, as well as the right to data portability. Where processing is based on consent, the data subject has the right to withdraw it at any time without affecting the lawfulness of the processing carried out on the basis of consent prior to withdrawal. Personal data will be stored for the period of Club membership and after its termination, until the expiry of the statute of limitations on possible claims in accordance with the provisions of the Civil Code. Where data are processed on the basis of consent, the data will be processed until the consent is withdrawn.
- In case of change of personal data, in particular the data used to contact the Club Member, the Member undertakes to notify the Organiser in order to update the data, in particular to enable the Organiser to conduct correspondence in connection with the Membership. Failure of a Club Member to notify the Organiser of a change in his/her contact information shall exclude any liability of the Organiser in this regard.
VIII. Limitation of liability and limited warranty
- The Organiser does not guarantee permanent availability of the websites or their correct functioning. The Organiser informs that temporary lack of access to the Club websites is possible. Under the above circumstances, the Organizer's liability is excluded. In case of inaccessibility or dysfunction of the Club website, it is also possible to cancel membership and obtain additional information about the Club (including the current Regulations) at Cinemas.
- In case of doubts as to the correctness of the on-line application (in particular, in the absence of confirmation of the application) or in case of doubts as to the correctness of data transmission from www.cinema-city.pl/klub-nauczyciela, it is recommended to contact the Cinema or send a message directly to the address of the Teacher's Club: [email protected].
IX. Other Provisions
- The Organiser and the Club Members undertake to try to resolve any disagreements and disputes between them in an amicable way. In case an amicable settlement of the dispute proves impossible, it will be referred to a common court of law with jurisdiction over the place of residence of the Club Member.
- All rights and obligations arising from these Regulations shall be governed by Polish law
- The Member can obtain information about special offers, Club partners, and other information about the Club from the Customer Service Department by writing to the address [email protected] indicated on the Club website, or by filling in the contact form available on the Club website.
X. COMPLAINTS
- A Club Member has the right to file a complaint regarding the use of services provided as part of the Club activities.
- Complaints should be submitted immediately after the occurrence of the event giving rise to the complaint.
- Complaints should include at least: name, surname, contact details (postal address or e-mail address) and a description of the circumstances justifying the submission of a complaint by the Club Member.
- Complaints should be submitted using the contact form or to the e-mail address: ___.
- Complaints will be reviewed by the Organiser and a response will be sent within 14 days of receipt of the complaint. The response will be sent to the contact information indicated by the Club Member when submitting the complaint.
- The Organiser may request additional information if it becomes necessary to determine the facts and process the complaint
- Claims of the Club Member not considered or resolved in the complaint procedure may be pursued in court, in accordance with Article IX(1) above.
XI. Amendments to the Regulations and Final Provisions
- These Regulations are effective as of October 1, 2024 and replace the earlier version of the Regulations, i.e. those in effect until February 12th, 2024 r.
- The Organiser reserves the right to amend the provisions of the Regulations at any time and to inform the Club Members thereof also by indicating the date of the last amendment at the top of the Regulations published on www.cinema-city.pl/klub-nauczyciela. The current versions of the Regulations will also be available in the Organiser's cinemas which participate in the Club programme. Information on amendments to the Regulations will be made public by sending information on amendments to the Regulations to the Club Member's email address provided in the form, posting the relevant information on the Club website and in Cinemas – these actions will take place on the same day. Amendments shall enter into force with effect as of at least 14 calendar days from the date of notification made in the aforementioned manner, unless the Organiser sets a longer deadline.
- In the case of an amendment to the Regulations referred to in Article XI(2) above, the Club Member has the possibility to cancel their membership in the Club according to the Article V(9) of these Regulations within 14 days from the date of receipt of the information about the change in the Regulations.
- Amendments to the content of the Regulations during the Programme will not violate the basic principles of the Regulations, i.e. principles concerning the protection of personal data of the Club Members (unless the amendment is justified due to changes in the applicable law in this respect).
- The use of the Card by the Club Member after the introduction of amendments to the regulations will be understood as acceptance of the introduced amendments.
- The Organiser reserves the right to suspend or terminate activities of the Club at any time, with prior notice to the Member by sending the relevant information to the Club Member's email address indicated in the form, posting the relevant information on the Club website and in Cinemas (with effect after 30 calendar days from the date of notification). In case of suspension or termination of the Club Programme, the Organiser is obliged to send such information to the address of the Club Member provided in the form and to place information about the suspension or termination of the Club activities in the Organiser's Cinemas and on the Club website – these activities will take place on the same day. In such a situation, the Member will be entitled to exercise the rights of the Member within 30 calendar days as of the date of posting the notice in the manner specified above.
- These provisions of the Regulations do not exclude or limit the statutory rights of the Club Members.
